सोसायटीची थकबाकी वसुली साठी कलम १०१ ऐवजी आता कलम १५४ बी (२९ ) प्रमाणे कारवाई करावी. सोसायटीची थकबाकी वसुली साठी आधी कलम १०१ खाली कारवाई करता येत होती. नवीन मॉडेल बाय लॉ नुसार आता कलम १५४ बी (२९ ) प्रमाणे कारवाई करता येते. त्यासाठी सोसायटीने सर्व अकाउंट स्टेटमेंट व्यवस्थित ठेवले पाहिजे, न दिलेल्या देखभाल खर्चावर जास्तीत जास्त 21% व्याज आकारणी केली पाहिजे. व्याज आकारणीचा ठराव करून ठेवला पाहिजे, थकबाकी वसुली साठी ठराव करून सेक्रेटरी, अध्यक्ष यांना तसेच वकील नेमणूकीचा ठराव करावा, महिन्याच्या महिन्याला प्रत्येक सभासदास बिल पाठवावे, कमीत कमी तीन मागणी पत्रे पाठवावी आणि त्याची पोच घ्यावी, प्रत्येकी १५ दिवसाच्या अंतराने, ज्यास्तीत ज्यास्त तीन चार सुनावणी मधे रजिस्ट्रार निकाल देतात आणि वसुली दाखला देतात, तसेच वसुली दाखला वसुली अधिकारी नेमून त्यांना द्यावा लागतो, वसुली अधिकारी तीन नोटिसा पाठवून रकमेची वसुली करून देतात. वेळप्रसंगी त्या सभासदाचे फ्लॅट वर ताबा पण घेता येतो. जर थकबाकीदार पुढे अपिलात गेला तर त्याला थकबाकीच्या ५० % रक्कम आधी सोसायटीत जमा करून त्याची पोच पावती घेऊन पुढे अपिलात जाता येते. तेव्हा सोसायटीच्या सर्व मॅनेजिंग कमिटीने सोसायटी ची थकबाकी वसुली करून व्यवस्थित काम करावे. यात मॅनेजिंग कमिटी वर असे थकबाकीदार लोक आरोप करतात परंतु जे लोक व्यवस्थित मेंटेनन्स देतात त्यांनी अशा कमिटी च्या पाठीशी खंबीर पणे उभे राहिले पाहिजे. आपणास मोफत मार्गदर्शन हवे असेल तर आपण अखिल भारतीय ग्राहक पंचायत कडे संपर्क करा. आमचा पत्ता : अखिल भारतीय ग्राहक पंचायत,६३४, सदाशिव पेठ, कुमठेकर रोड पुणे ४११०३०. महाराष्ट्र सहकारी संस्था अधिनियम १९६० चे ७५(१) मधील तरतूद केल्या प्रमाणे तिचे कामकाज चालविण्यासाठी वित्तीय वर्ष संपल्या नंतर सहा महिन्याच्या कालावधीच्या आत व्यवस्थापक समितीने आपल्या सदस्यांची अधिमंडळाची वार्षिक बैठक बोलवावी. म्हणजे, वार्षिक सर्वसाधारण सभेची अंतिम तारीख होती ३० सप्टेंबर हे आपल्या सर्वाना माहित आहे. त्या नुसार सर्व सहकारी गृहनिर्माण संस्थेनी आपली वार्षिक सर्वसाधारण सभा घेतली असणार असे मी समजतो. परंतु कित्येक वेळास असे आढळून येते की, नियमप्रमाणे जी वार्षिक सर्वसाधारण सभा बोलविण्यास पाहिजे ती बोलवली जात नाही. तेव्हा कलम ७५ च्या पोट कलम १ अन्वये निबंधकाला सर्व नियमाचे पालन करून सभा बोलविता येते. आणि अशी बोलविलेली सभा हि संस्थेने बोलाविलेलीच सभा आहे असे समजले पाहिजे. अशी सभा बोलावण्यासाठी आलेला खर्च संस्थेच्या निधीतून किंवा निबंधकाच्या मते सर्वसाधारण सभा बोलविण्यास नकार दिल्याबद्दल किंवा कसूर केल्याबद्दल जी व्यक्ती किंवा ज्या व्यक्ती जबाबदार असतील त्या व्यक्तीने दिला पाहिजे अशा असा आदेश निबंधकास देता येईल. नियम ६३ नुसार वार्षिक सर्वसाधारण सभा संस्थेने बोलाविली नाही तर निबंधक किंवा त्याने नेमलेला अधिकारी किंवा कर्मचारी वरील सभा बोलविण्यास पात्र राहील व सर्वसाधारणपणे जो अधिकार सदर, सभा बोलवणे, तिचे कामकाज चालविणे वैगरे कामे करतो ती सर्व कामे करण्यास त्याला अधिकार राहील. सभा न बोलविण्याबद्दल शिक्षा : संस्थेची अधिमंडळाची वार्षिक बैठक बोलविण्यास किंवा कलम ७५पो.क. (२), (२-अ ), (३) किंवा (४) अन्वये सभा बोलविण्यास जो संस्थेचा पदाधिकारी किंवा समितीचा सदस्य, कोणतेही योग्य कारण नसताना कसूर करेल तर निबंधक त्या सदस्याला सदस्यत्वावरून पाच वर्षाकरीता काढू शकतो व तो संस्थेचा अधिकारी किंवा कर्मचारी असेल तर ५०००/- रुपयापर्यंत दंडाची शिक्षा करू शकतो कलम ७५(५)परंतु हा निर्णय घेताना संबंधित व्यक्तीस, तसेच तिच्याबाबतीत जी कारवाई करण्याचे योजले असेल तिच्या विरुद्ध कारण दर्शविण्यास वाजवी संधी दिली पाहिजे किंवा अशी देण्याची व्यवस्था केली पाहिजे. कलम ७५(६) अन्वये संबंधित व्यक्तीला झालेला दंड फॊजदारि प्रक्रिया संहिता १९७३ यात दंडाधिकाऱ्याने केलेला दंड वसूल करण्यासाठी जी रीत दिलेली आहे त्या रीतीने जणू असा दंड स्वतः दंडाधिकाऱ्याने केला होता असे समजून, (कलम ४२१, ४२२, व ४३१ अन्वये ) वसूल करता येतो. या आदेशा विरुद्ध कलम १५४अन्वये राज्य शासनाकडे आणि निबंधकाकडे पुनरीक्षणविषयक अर्ज दाखल करून शकतो. वार्षिक सर्वसाधारण सभा अपुरी, स्थगित किंवा कार्यक्रम पत्रिकेवरील विषय राहिले असेल तर ? 🤍 "SAHAKAR BHANN" channel publishes programs in "Housing & Co-operative" general.
